Concept of environmental impact assessment system:

 

Through meticulous process analysis and material accounting, the background monitoring of the surrounding environment and mathematical model prediction, the environmental impact assessment is used to analyze the type, quantity, concentration, the pollution impact range and degree of pollution generated in the process of the project production process, evaluate the pertinence and feasibility of the pollution prevention and control measures to be taken by the project unit, and finally make evaluation conclusions such as the consistency of the industrial policy of the construction project, the rationality of site selection and the controllability of pollutant emissions that meet the standards.

 

Article 16 of the Environmental Impact Assessment Law of the People's Republic of China shall carry out classified management of the environmental impact assessment of construction projects according to the degree of environmental impact of construction projects

 

The construction unit shall organize the preparation of environmental impact reports, environmental impact reports or environmental impact registration forms (hereinafter referred to as environmental impact assessment documents) in accordance with the following provisions:

1. If it is possible to cause significant environmental impacts, an environmental impact report should be prepared to conduct a comprehensive evaluation of the resulting environmental impact;

2. If it is likely to cause a mild environmental impact, an environmental impact report form shall be prepared to analyze or specially evaluate the resulting environmental impact;

3. If the environmental impact is very small and there is no need for environmental impact assessment, the environmental impact registration form shall be completed.

 

Article 3 of the Administrative Measures for Post-environmental Impact Assessment of Construction Projects (Trial), which came into effect on January 1, 2016, stipulates that if the following environmental impact statements do not meet the examination and approval arise during the operation of the following construction projects, post-environmental impact evaluation shall be carried out:

1. Construction projects with large actual environmental impacts and scope in the water conservancy, hydropower, extractive, ports and railway industries, and the main environmental impacts gradually appear after a certain period of completion and operation of the project, and construction projects in other industries that cross important ecologically sensitive areas;

2. Construction projects with major environmental risks in the metallurgical, petrochemical and chemical industries, sensitive construction sites, and continuous emission of heavy metals or persistent organic matter;

3. Other construction projects that the competent administrative department of environmental protection believe should be carried out after environmental impact assessment.

There are three types of environmental impact assessment documents: reports, reporting forms and registration forms (the "EIA Law" has specific provisions, and there are specific introductions below). Specifically, which construction projects require environmental impact assessment? As long as the construction of a project that has an impact on the environment, regardless of the investment subject, source of funds, nature of the project and the scale of investment, the environmental impact assessment shall be carried out in accordance with the provisions of the Environmental Assessment Law and the Environmental Protection Regulations of the construction project, and submit the environmental impact assessment documents to the environmental protection administrative department for approval. In this sense, as long as the construction project is new, expansion and reconstruction, environmental assessment is required.
When will the environmental impact assessment be carried out for the construction project?
Since the promulgation of the Regulations of the State Council on the Reform of the Investment System (No. 20 [2004] of the State Council), the examination and approval system of projects has been gradually reformed in the direction of investment, the government approval system has been standardized, and the filing system has been continuously improved, and there are clearer requirements for the time of environmental impact assessment. For construction projects that implement the examination and approval system, the construction unit shall complete the formalities for submitting the environmental impact assessment documents before submitting the feasibility study report; for construction projects that implement the approval system, the construction unit shall complete the procedures for environmental impact assessment and approval procedures before submitting the project application report; for construction projects that implement the filing system, the construction unit shall complete the filing and approval procedures for submitting the environmental impact assessment documents after going through the project.
